Where-Paterson NJ

Situation- A claimant testified that due to a work place accident he was severely injured and was not able to continue working. The only face to face interaction anybody had with the claimant was with the defense attorney, months ago at the deposition. The case file did not have a pictures of the claimant face. The only description the attorney was able to provide was a 29-year-old, Hispanic male, approximately 5 foot 7 inches, and medium build. The adjuster and the defendant’s attorney believed the claimant was not injured severely as claimed and was probably employed. The adjuster and attorney wanted to conduct manned surveillance to monitor the claimant’s activity and attempt to verify if he was currently working.

Problem- Identify and perform manned surveillance on an individual without any pictures of the claimant.The only reference was:

Anyone with any experience in performing surveillance investigations will agree that the circumstance involving this claim is an almost impossible task. If we were to utilize traditional surveillance methods, the only strategy available would be committing several days of manned surveillance, documenting any individual with a similar physical description. Then we would have to compile all the pictures and video and send it to the insurance defense attorney to possibly confirm the claimant’s identity.

Solution- Capital Insurance Defense Services deployed a static camera outside the claimants reported apartment building for one week. After reviewing the evidence, we were able to identify five male individuals that lived at the apartment building who matched the description of the claimant. We provided the footage to the insurance defense attorney; with the clear and definitive pictures of the suspected individuals; the defense attorney had no difficulty in positively identifying the claimant. Having a positive identification of the claimant, we reviewed the static camera evidence again and established that the identified claimant had a consistent daily schedule. The claimant left the building at approximately at 6:45am and returned at 4:40PM Monday through Friday.

The next day we performed manned surveillance and obtained video footage of the claimant going to work at a construction site, and performing physical tasks that contradicted his previous testimony.

Outcome– An almost impossible case resulted in client obtaining powerful evidence to refute claim. Use of the static camera was able to provide:

  • A positive identification of the claimant
  • Confirmation of residence
  • Identify vehicles driven and usual parking space by claimant
  • Consistent daily schedule of claimant
  • Best areas available to start manned surveillance
